Texas Government 83rd Legislative Session Update: HB 38

House Bill No. 38 passed in the state Senate on May 22nd of 2013. It passed in the House of Representatives on April 10th of 2013. The bill will be enacted on September 1st of 2013, and will apply to all occurrences on this date or after. This bill amends the current transportation code by increasing the penalty for all motor vehicle airbag related criminal offenses from a Class A misdemeanor to a state jail felony. Airbag related offenses are not very common in Texas. In the fiscal year of 2012, less than 10 people were arrested for these offenses. As such, there is no significant projected fiscal impact.
